General

• Welcome to the Advanced Biomedical Laboratories website terms and conditions and thank you for visiting our website.
• This website is owned by Advanced Biomedical Laboratories, US (ABL).
• Please read through them carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Please also read our Privacy Statement regarding personal information provided by you.
• Before placing an order, if you have any queries relating to these terms and conditions, please email our customer service team at advancedbiomedicallabs.com.
• ‘Advanced Biomedical Laboratories', ‘us' ‘our' and ‘we', when used in these terms and conditions, refer to Advanced Biomedical Laboratories, its officers, directors, agents and affiliates. Reference to the terms 'you' 'your' and 'yours', when used in these terms and conditions, shall mean any user of this website at anytime. The term User shall refer to the user who is browsing the site.
• We accept no liability to the maximum extent allowed by law for the accuracy of information on the website which may have typographical errors, or information on a product which may contain technical inaccuracies relating to their use of a product for example, scientific evidence of which may be incorrect or inadequate. However, this provision does not affect your statutory rights and remedies.

Acceptance of Order

Advanced Biomedical Laboratories, in its sole discretion and without cause, may refuse to accept an order in whole or in part prior to delivery, if we decline an order we will refund all payments made by you in respect of that order.

Product Quality

A Certificate of Analysis is issued for most products and those products sold in research scale quantities. Purity criteria include as judged by satisfactory HPLC, elemental analysis, melting point and 1 H and 13 C NMR spectra.

Other products are sold based solely on the basis of satisfactory 1H and 13C NMR spectra.

Product Safety

We will provide a Materials Safety Data Sheet with our products. The products must used in accordance with its instructions which would explain the hazards associated with a product, as well as what precautions to take to avoid those hazards. Please note that not all products have or need to have an MSDS sheet.

Purpose of Use

Our research grade products are non cGMP products and are intended for laboratory research purposes only and are not to be used for any other purposes including, without limitation, use in the preparation of food or pharmaceutical products or testing on humans.

Note that these research grade bionutrients are not pharmaceutical grade chemicals and are NOT fit for human consumption.

Price and Payment

• Prices are in US dollars and will be made available to customers when enquiries are made. Payments can be made in advance else payment is to be made within 31 days of the date of invoice.
• A minimum purchase price of US$250 applies (plus freight). Handling and freight charges for all orders with the exception of bulk orders are US$95.00 and for US orders $20.00. Bulk pricing is available.
• Customers outside US will also be liable for any product restrictions and other local requirements. You are advised to check the latest applicable local requirements before placing an order.
• The total price payable for the goods will be stipulated at the time when you place your order whether or not the order has been confirmed.
• However, we reserve the right to review the price of any item including shipping and handling. If any item you have ordered is subject to any increase in price, we will notify you prior to dispatch.
• We will confirm if any adjustments need to be made to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties and other charges, or if due to an error or omission the price provided for the goods is wrong whether or not the order has been confirmed. We will then inform you of the correct price.

Cancellation

Once an order is placed, it may only be cancelled in part or in whole with our consent or as otherwise the circumstances specified in these terms and conditions and policies. Orders that cannot be cancelled will be subject to our terms, conditions and policies relating to returns outlined here. You may not cancel any agreement for the sale of goods that were made to your particular requirements or which are clearly customized.

Delivery

We will deliver your products to the delivery address given by the customer as shown on your order. Anyone at the delivery address who receives the goods shall be presumed to be authorised to receive the goods.

You will be provided with an estimated delivery time when you make enquiries or place your order. We will make every effort to deliver your product within the estimated delivery time but the actual delivery times may change due to raw material supply-side problems, technical difficulties or circumstances beyond our control. Advanced Biomedical Laboratories will not be liable for any damages or loss caused by delays. Stipulated delivery times are only good faith estimates and Advanced Biomedical Laboratories is not be liable for any failure to deliver by such dates. Where technical or other queries requiring your approval cause the processing of the product to be delayed, the delivery time is automatically extended by the time taken to answer such queries. If the circumstances cited such as-technical or raw material supplies-should render delivery impossible or unreasonable, we shall be released from the obligation to deliver and reserve the right to cancel the order.

We will use reasonable efforts to complete all delivery and handling documentation and declarations as are reasonably required in relation to international shipments of goods. However, we are not responsible for any cost incurred such as cost for any tax or duty imposed and cost of any other documentation and paperwork. These costs will be quoted separately before your order is confirmed or processed.

Returns

Returns will be accepted and refunds given for damaged goods or incorrect deliveries. We request that you must notify us in the event of any claim for faulty, damaged or incorrectly delivered goods within 14 days of receipt if goods are to be eligible for returning. After this time we are not obligated to accept any claims received nor are we liable in respect of such claims.

Availability of Products

All items are sold are subject to availability. The information on the availability of products comes directly from us and is provided to you at the moment a product enquiry is made and before an order is put through. We cannot be held responsible for any error or exceptional modifications to agreed available time frames. In the event that a product is or will not available after you have placed an order, we will inform you by email or phone call as quickly as possible so that you may cancel your order.

Warranty

Advanced Biomedical Laboratories back the quality and reliability of our listed products. Advanced Biomedical Laboratories further expressly warrants that our products are of merchantable quality and product will meet the specifications stated on the technical data sheet. Considering the above promises all other warranties or guarantees-expressed or implied relating to our products or their use- are hereby expressly excluded to the maximum extent allowed by law.

Liability

Without deference from and to the maximum extent permitted by law, Advanced Biomedical Laboratories sole liability (whether that liability arises in contract, tort (including negligence), statute or however it occurs) to you is strictly limited to the replacement of the product and the refund of the payments made for the products. In no event or under any circumstance will we be liable for any cost of any kind, including without limitation, lost profits, incidental, special or consequential loss, indirect losses resulting from our products or their use or use of our website.

Indemnity

You agree to indemnify and hold us harmless against any loss, damage, claim, costs or expense, we may suffer or incur and including any charges or complaints made by other parties against you as a result of any use of our products or use of the website by you. You assume all risks and liabilities for the use of our products.

Ammendments to this Agreement

From time to time we may amend these terms without prior notice to you. The amended terms and conditions are posted on this website and will be effective from the date and time they are posted. Your continued use of this website after we have posted any amendments to these terms and conditions constitutes your acceptance to the terms and conditions as amended.

Governing Law

This website and the terms and conditions of use are governed by and construed in accordance with the Laws of US, without regard to its conflict of laws principles. Users of the website submit to the non-exclusive jurisdiction of US Courts. The United Nations Convention on the International Sale of Goods is not applicable to these agreements.
